Terms of Service.
These Terms of Service constitute a legally binding agreement between you (the Client) and Paradise Transport, LLC regarding the provision of our freight, cargo, delivery, and passenger transport services.
1. Provision of Transport Services
Paradise Transport, LLC agrees to provide transport services as described in a written quote, service agreement, or confirmed booking. Services may include local and regional freight, scheduled routes, and related logistics support. Paradise Transport, LLC retains operational discretion over vehicle assignment, routing, and qualified personnel used to complete each job safely and efficiently.
2. Scheduling, Access, and Client Responsibilities
Pickup and delivery times are estimates based on traffic, weather, and operational conditions. Timely completion depends on the Client providing accurate addresses, accessible loading areas, proper packaging, and required documentation. Delays caused by incomplete information, restricted site access, or late readiness at pickup may extend timelines without penalty to Paradise Transport, LLC.
3. Fees, Payment, and Additional Charges
The Client agrees to pay transport fees according to the accepted quote or invoice. Quoted rates cover the services described at booking. Additional charges may apply for waiting time, extra stops, special handling, tolls, or changes requested after confirmation. Paradise Transport, LLC does not advance third-party fees on behalf of the Client unless expressly agreed in writing.
4. Cancellations and Contract Duration
Cancellation terms are stated in your quote or service agreement. For recurring or contracted routes, an initial commitment period may apply as specified in your contract. After any commitment period, services may continue on a rolling basis until either party provides written notice as required. Upon termination and payment of outstanding invoices, Paradise Transport, LLC will close open bookings and return any Client-owned materials in our possession.
5. Limitation of Liability
Under no legal theory shall Paradise Transport, LLC be liable for indirect, consequential, punitive, or special damages arising from transport services, including lost profits, business interruption, or indirect shipment delays. Maximum aggregate liability for any claim related to services rendered shall not exceed the total transport fees paid by the Client to Paradise Transport, LLC during the sixty-day period immediately preceding the event giving rise to the claim, except where a higher limit is required by applicable law or covered by insurance stated in writing.
